Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of FacetCAM (“the Service”), a gemstone platform spanning photoreal stone-video rendering (FacetCAM Studio) and faceting CAD/CAM, operated by FacetCAM (“we”, “us”, “our”). By creating an account, starting a free trial, purchasing lifetime access, or purchasing render credits, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. By using the Service you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorised use of your account at [email protected].

4. Free Trial

New FacetCAM CAD/CAM accounts receive a 5-day free trial with full access. No payment method is required to start the trial. The trial begins at the time of account creation and ends automatically after 5 calendar days, after which access becomes read-only until you purchase lifetime access. FacetCAM Studio does not use a timed trial: creating a Studio account is free, single-frame test stills are free, and finished renders are paid for with credits as described in Section 5.

Each user is entitled to one free trial. We reserve the right to revoke trial access at our discretion in cases of abuse (for example, creating multiple accounts to extend the trial).

5. Purchases and Payment Terms

Lifetime access to FacetCAM is available for a one-time payment of $99 USD (plus any applicable taxes). Payment is processed by our third-party payment provider, Paddle.com Market Limited, acting as Merchant of Record.

“Lifetime” refers to the lifetime of the Service, not the lifetime of the user. Your lifetime licence remains valid for as long as the Service continues to operate (including under any successor). In the unlikely event the Service is permanently discontinued, we will make reasonable efforts to notify users in advance but we make no guarantee of refund or replacement for a discontinued service beyond the refund window described below.

Lifetime access includes:

  • All current non-AI features of FacetCAM
  • All future non-AI features and improvements released during the lifetime of the Service
  • The current and future design library

Exclusion: AI-powered features. Any features that use AI models or large-language-model inference (for example, AI design generation, AI-assisted PDF diagram import, or chatbot advisors) are sold separately as token-based add-ons because they incur real per-request compute costs. These add-ons will be clearly identified and separately priced at the point of purchase. They are not included in lifetime access.

FacetCAM Studio render credits. Renders on FacetCAM Studio are paid for with credits, sold as one-time credit packs (no subscription) and likewise processed by Paddle as Merchant of Record. Credits are consumed per render, do not expire, and remain on your balance until spent. Credit prices and pack sizes (plus any applicable taxes) are shown at the point of purchase.

6. Refunds

We offer a 14-day money-back guarantee on lifetime purchases and on FacetCAM Studio credit packs whose credits are unspent. Credits already spent on renders are not refundable. See our Refund Policy for full details.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Present any render as a photograph of a physical stone, as evidence of laboratory grading or certification, or in any misleading listing, offer, or advertisement; renders shared with consumers must be disclosed as computer-generated imagery
  • Attempt to reverse-engineer, decompile, or otherwise extract the source code or algorithms powering the Service, except to the extent such restriction is prohibited by law
  • Resell, redistribute, or provide the Service (or derived access) to third parties without our written permission
  • Use automated means (bots, scrapers) to access the Service beyond publicly documented APIs
  • Upload or transmit malicious code, viruses, or any content designed to harm the Service or other users
  • Interfere with or disrupt the integrity or performance of the Service

Renders, listings and disclosure. A render is a computer-generated depiction of a cut specification. It is not a photograph, not a measurement of a physical stone, and not evidence of colour, clarity, inclusions, fluorescence, treatment history or origin — those are properties of an individual stone that no render produced from a specification can show. Where you use a render in a listing, offer or advertisement, you must state in the same listing that the image or video is computer-generated; and where the stone depicted has not yet been grown, cut or finished, you must also state that it depicts a stone that does not yet exist. You are responsible for complying with the disclosure and nomenclature rules of every market in which you sell — these differ by jurisdiction, and neither these Terms nor the FacetCAM Reference is legal advice on them. You will indemnify us against claims, losses and costs arising from your use of a render in any listing, advertisement or sale.

Misuse and Suspension. We may remove assets, disable features, or suspend or terminate accounts that we reasonably believe are using FacetCAM to create deceptive listings, misleading advertisements, forged or misleading report references, or other unlawful or policy-violating materials.

8. Your Content and Designs

Faceting designs, scripts, G-code outputs, and other content you create or upload remain your property. By using the Service, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the Service to you.

Our design library contains designs from various sources, each with its own attribution and licence. You are responsible for ensuring your use of any design complies with the designer's licence terms and any applicable copyright law.

9. Intellectual Property

The Service, including its software, source code, shaders, user interface, and branding, is the intellectual property of FacetCAM and is protected by applicable copyright and trademark laws. Except as expressly set out in section 9.1, these Terms do not transfer any ownership to you.

9.1 The FacetCAM Reference — free to reuse

What is licensed. Each page of the FacetCAM Reference that displays a Creative Commons licence notice at its foot (each a “Reference Page”) is licensed to everyone under the Creative Commons Attribution 4.0 International licence (CC BY 4.0). That grant covers the written text of the page, its data tables, its illustrations and diagrams, and the source code of any interactive figure embedded in it. You may copy, adapt, translate and redistribute that material, including commercially and in teaching materials, on the terms of that licence.

We publish it on those terms because it is teaching material, and teaching material that cannot be reused is not much use to a lecturer.

How to tell what is covered. The licence notice printed at the foot of a page is the grant. A page that carries no such notice is not licensed under this section, whatever its address. We may add, revise or withdraw Reference Pages at any time; withdrawing a page does not affect copies already made under this licence, which cannot be recalled.

Third-party material. Some Reference Pages include or describe material we did not create. Any item identified on the page as belonging to a third party — a credited figure, photograph, extract or quotation — is excluded from this licence and you must clear it with its owner separately. Facts, measurements, physical constants and published specifications stated on a Reference Page are not owned by us; this licence neither grants nor restricts your use of them, and it is not a warranty that they are accurate (see section 10.2).

What is not licensed. This section does not cover: the FacetCAM name, logo or other trade marks; the software, source code or shaders that produce our renders, or any other part of the Service; the faceting design library, whose entries carry their own separate licences and restrictions (see section 8); rendered videos, images or share links produced for customers; or any page of the Service that does not carry the licence notice. Nothing in this section grants permission to imply that FacetCAM endorses you, your work, your institution or your product.

How to credit us. CC BY 4.0 requires you to name the creator, state the licence and link to it, link to the specific page you took the material from, keep any disclaimer notice we supplied, and say if you changed anything. If you reuse a page unchanged:

Each Reference Page also offers a copyable bibliographic citation. A citation is not an attribution: if you are quoting or citing us, the citation is enough; if you are copying, adapting or redistributing the material, use the credit form above.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities.

Brightness analysis, G-code output, and other calculated results are provided as tools to assist faceters. You are responsible for verifying all outputs before using them to cut gemstones or operate machinery.

10.2 The FacetCAM Reference

The FacetCAM Reference is published as general technical and educational information. It is not gemmological, engineering, safety, legal or commercial advice, and it is not a specification for operating any equipment. Refractive indices, critical angles, machine pressures, temperatures, growth rates and other figures are class-typical published values that vary by sample, by source and by method of measurement. They must be independently verified against a primary source, and against the relevant manufacturer's own documentation, before being relied on to cut a stone, to specify, operate, service or purchase any machine, or to make any representation to a customer.

Diamond growth and treatment involve pressures, temperatures and electromagnetic fields capable of causing serious injury or death. Nothing in the Reference is instruction, encouragement or a procedure to attempt any of it. Descriptions of how laboratories distinguish grown from natural material describe laboratory practice; they are not a field guide, and no stone should be represented as grown or natural on the strength of them.

We give no warranty that the Reference is accurate, complete or current, and we accept no liability for loss arising from reliance on it, whether you read it on our site or in a copy or adaptation published by someone else. Subject always to section 11.

Where material is reused under section 9.1, this section 10.2 is a notice referring to the disclaimer of warranties for the purposes of that licence, and must be retained in copies and adaptations.

11. Limitation of Liability

To the maximum extent permitted by law, FacetCAM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from or related to your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you have paid us in the preceding twelve months, or one hundred US dollars ($100), whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, you have statutory rights that these Terms do not affect, and nothing in these Terms operates to exclude, restrict or modify those rights.

12. Termination

You may close your account at any time by contacting us at [email protected]. We may suspend or terminate your account if you violate these Terms, with or without notice.

Termination does not entitle you to a refund of a lifetime purchase or of credit packs beyond the 14-day refund window described in the Refund Policy.

13. Changes to the Service and to these Terms

We may modify or discontinue features of the Service at our discretion. We may also update these Terms from time to time. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall be resolved first through good-faith negotiation via email; if unresolved, by the courts of England and Wales.
